COMMISSION REGULATION (EC) № 330/2010 of April 20, 2010 the application of Article 101, paragraph 3 of the Treaty on the Functioning of the European Union to categories of vertical agreements and concerted practices. The regulation defines what constitutes a “vertical agreement”, “vertical restraint”, “competitive enterprise”, “obligation to refrain from competition”, “selective distribution system” and others that are directly related to franchising.
Guidelines on Vertical Restraints to COMMISSION REGULATION (EU) № 330/2010. European Commission has adopted Guidelines on Vertical Restraints, which indicate how to treat vertical agreements that are not covered by the group block exemption. On page 39 you can see the specific guidelines relating to franchising.
European Code of Ethics for franchising (EN)– This European Code of Ethics is in line with the updated version of the first development of the Code in 1972 by the European Franchise Federation (EFF). The idea of this code of ethics is to gather basic provisions for the fair conduct of the franchise functionaries in Europe.
